MILWAUKEE — A bench warrant has been issued for a 79-year-old nun charged with inappropriate behavior after she failed to appear at a hearing.

Norma Giannini is charged with two counts of indecent behavior with a child stemming from incidents involving boys at a school where she had been principal.

Milwaukee County Assistant District Attorney Paul Tiffin said Monday the warrant was issued after Giannini failed to appear at a hearing Friday.

She was charged last December and accused of having repeated sexual contact during the 1960s with some students who attended St. Patrick's School in Milwaukee.

Sheila King, with the Chicago region of the Sisters of Mercy, said Giannini hadn't realized she was required to attend the hearing last week.

A Roman Catholic nun pleaded no contest yesterday to two counts of indecent behavior with a child in connection with accusations from the 1960s when she was a principal and teacher at a Catholic school in Milwaukee.

The nun, Norma Giannini, 79, faces up to 20 years in prison for what prosecutors say was sexual abuse of two male students.

Although dozens of nuns have been accused of sexual abuse, often in civil lawsuits, Sister Giannini is one of the first to face criminal charges, said Anne Barrett Doyle, co-director of BishopAccountability.org, a group that compiles reports about abuse in the Roman Catholic Church.

Mary Pat Fox, president of Voice of the Faithful, a lay group formed in response to the Catholic sexual abuse scandal, said she hoped the case would encourage more victims of nuns to come forward. “I think this is the tip of the iceberg,” Ms. Fox said.

According to a criminal complaint filed by the Milwaukee County district attorney’s office, Sister Giannini repeatedly assaulted the two boys while they were in middle school at St. Patrick School. The complaint said the assaults included intercourse and occurred in numerous locations, including a convent and a classroom.

The men who say they were abused, Gerald Kobs and James St. Patrick, now in their 50s, attended Monday’s hearing in Milwaukee.

“This is just a tragic situation for everyone involved,” said Sister Betty Smith, president of the Regional Community of Chicago of the Sisters of Mercy, the religious order to which Sister Giannini belongs.

Sister Smith said Sister Giannini had been removed from work with minors after one of the men came forward with accusations in 1992. She will be sentenced on Feb. 1.

MILWAUKEE, Ill. (AP) ― A 79-year-old Roman Catholic nun from Illinois pleaded no contest Monday to two counts of indecent behavior with a child for alleged sexual encounters with two male students at a church convent and school where she was principal during the 1960s.

The nun, Norma Giannini, listed in online court records as living in Oak Lawn, Ill., and her attorney left the courthouse without comment after entering the pleas in Milwaukee County Circuit Court.

Giannini faces a maximum 10 years on each count when sentenced Feb. 1.

According to the criminal complaint, the two men told authorities they had dozens of sexual encounters with Giannini, including intercourse, while attending St. Patrick's School in Wisconsin.

One man said the nun told him in 1965, when he was 13, to open the buttons of her habit, but he was shaking so badly he could not do so. He said she then unbuttoned her clothing and had him touch her breasts, the complaint said.

The first incident was followed by 60 to 80 others, including two involving sexual intercourse, it said.

The other man said he had sexual contact with the nun more than 100 times, beginning when he was in seventh grade. At least one incident involved sexual intercourse, the complaint said.

Giannini went on to work in Illinois from 1970 to 1994.

Sister Betty Smith, regional president for the Sisters of Mercy in Chicago, has said the nun received extensive counseling at a St. Louis treatment facility after the order "learned of the situation" during the 1990s.

Giannini has been closely monitored and separated from minors since then, Smith said. The nun has been retired from active work for five years because of failing health, she said.

Sister Betty Smith, regional president for the Sisters of Mercy in Chicago, said the nun received counseling after the Sisters learned of the accusations in the 1990s.

She said Giannini has been closely monitored and separated from minors since then.

The sentencing is scheduled for February. Giannini remains free on bail. She left the courtroom without comment.

"Her not giving any type of statement afterwards is still her posture of never admitting she did anything wrong," victim Jerry Kobs said.

For Kobs, it's only a matter of now weeks before he can confront her in court. He said he has been thinking for years about what he'll say -- about how he could never bring himself to tell his mother.

Giannini's lawyer said she entered the plea to spare everyone a trial and because Giannini's in poor health, he is still working on what he will ask for at her sentencing.

Prosecutors are expected to seek four years in prison, 12 News reporter Nick Bohr said.

A Roman Catholic nun who sexually abused two teenage boys in Milwaukee four decades ago admitted to a church panel that she also had molested a Chicago boy and at least three other minors, according to a court document obtained by the Tribune.

Sister Norma Giannini, 79, avoided trial in November by pleading no-contest to two felony counts of indecent behavior with a child. She faces up to 20 years in prison when she is sentenced Friday at Milwaukee County Courthouse.

Two known victims in the case, Gerald Kobs and James St. Patrick, are expected to read statements in court. According to a criminal complaint filed December 2006, Giannini engaged in dozens of sexual encounters with them in the 1960s, when she was an 8th-grade teacher and principal at St. Patrick's School in Milwaukee.

But court documents show that a psychologist told prosecutors in 2006 that Giannini had identified other victims to a Milwaukee archdiocese panel. The psychologist and other members of the panel interviewed Giannini in 1996 after abuse allegations emerged.

Because church officials did not report the allegations to law enforcement at the time, prosecutors began building their case in 2005 only after victims approached the civil authorities.

Prosecutors subpoenaed the psychologist, Elizabeth Piasecki, who read into the record the notes she wrote during the interview.

The notes indicate Giannini discussed molesting three other boys in Milwaukee and one in Chicago, where she worked before and after her stint in Wisconsin.

According to a transcript, Piasecki read: "One thing happened at St. Ann's before Milwaukee, a young man, a student. First time it happened. He was 14 to 15. He was in 8th grade. Started kissing and petting. I was talking to him and all of a sudden he was kissing me. Then it went on. And then unfortunate."

Piasecki's notes on the other alleged victims include: "There's one more boy ... he was 16 years old ... going on 20. I knew nothing. Kissing and petting, I think."

At one point, the panel asked Giannini: "What do you think that these kids thought?"

Giannini answered: "They were sowing their oats. How many teenagers would resist that opportunity?"

Sheila King, a spokeswoman for the order Sisters of Mercy of the Chicago Regional Community, said she could not confirm the existence of additional victims because the sister who was president at the time of those allegations is unavailable. The current president, Sister Betty Smith, assumed her title in 2006.

The Chicago archdiocese, where Giannini served in schools for decades, referred all questions to her order.

A native of Chicago, Giannini entered the convent at 18. She started teaching in 1949 at St. Paul of the Cross in Park Ridge, followed by several other schools in the Chicago area before being sent to Milwaukee in 1964.

Giannini returned to Illinois in 1969, working at Christ the King, Mother McAuley High School, Little Flower, St. Clare of Montefalco and Holy Redeemer, where she was principal. Sisters of Mercy removed Giannini from service in December 1992 when the Milwaukee archdiocese notified the order of allegations against her.

Milwaukee County Assistant District Atty. Paul Tiffin confirmed that he was aware of other potential victims. In addition to Kobs and St. Patrick, one other man came forward but did not press charges, Tiffin said.

"We did know she had mentioned other victims, but we made no effort to contact them because these people are adults," he said. "We're not going to force anyone to come forward. These are terrible memories that some people just don't want to bring up."

Prosecutors in Milwaukee could have referred their findings to Illinois authorities in an attempt to search out more victims but had no professional obligation to do so, said Mark Rotert, a former federal prosecutor and Illinois assistant attorney general.

Rotert noted that the crimes apparently are not ongoing and the victims know who abused them. "It's their choice if they want to come forward," he said. "It's also their choice if they don't want to come forward."

Even if Cook County authorities had received the information, the time limit for prosecuting the sexual abuse in Illinois likely would have run out, said John Gorman, spokesman for State's Atty. Richard Devine. Milwaukee authorities could prosecute Giannini because Wisconsin's statute of limitations halts if the alleged offender leaves the state.

Kobs and St. Patrick said Thursday in an interview that they lived with memories of abuse for more than 30 years before coming forward.

Kobs said he often considered suicide and suffers frequent migraines and recurring nightmares of abuse. St. Patrick said he abused alcohol and drugs for years after the abuse, which destroyed his faith.

"I thought, why didn't Jesus stop this?" he said.

Both men said Giannini had abused several other boys in their school, whom they have been trying to contact. One victim committed suicide, they said, and two others have sexually assaulted women.

Kobs said he hopes the judge sentences Giannini to at least 8 years in prison, which prosecutors are recommending.

"I just hope she gets some time," Kobs said. "If we go through this mess, and she gets no punishment, how will that make other victims of abuse feel?"

MILWAUKEE—A Roman Catholic nun was sentenced Friday to a year in jail and 10 years' probation for sexually abusing two teenage boys at an elementary school in the 1960s.

Judge M. Joseph Donald said he spent much time contemplating a suitable punishment for Sister Norma Giannini's crime.

"I'm struggling to understand how it is that someone who spent their entire life providing education and friendship . . . could have been so diabolical," Donald said.

Giannini, 79, engaged in dozens of sexual encounters with two boys, beginning when they were 12 and 13, while serving as an 8th-grade teacher and principal at St. Patrick's School, according to the 2006 criminal complaint.

Her stint at the Milwaukee school lasted from 1964 to 1969. Giannini also taught in several Chicago schools from 1949 to 1964 and again from 1970 to 1992, when the Sisters of Mercy removed her over allegations of abuse. She has been living in southwest suburban Oak Lawn.

Donald sentenced Giannini to 10 years in prison on two felony counts of indecent behavior with a child, but he stayed the sentence in favor of probation and a year of incarceration at a Milwaukee County jail facility in Franklin, Wis.

The judge said he decided against sending Giannini to state prison because of her age and health problems. He also recommended Giannini meet with the two victims so she could hear how abuse has affected them.

Prosecutors had sought an 8-year prison sentence.

At the sentencing, victims Gerald Kobs and James St. Patrick read statements on how the abuse had affected them psychologically, hurt their families and destroyed their faith.

St. Patrick said he personally knows of at least 12 other boys abused by Giannini. One committed suicide, and two others have sexually assaulted women, he said.

After he was abused, he said, his own life spiraled downward.

"I was sure I was going to hell for defiling a holy sister," said St. Patrick. "What worse sin could there be? . . . I've been suicidal on and off ever since. I spent decades trying to escape it all through drugs and alcohol. I hated myself."

Giannini read a brief handwritten statement of remorse.

"Long before this trial, I realized how certain actions of mine have caused pain, confusion and emotional trauma," she said. "I ask forgiveness from the bottom of my heart. . . . I ask forgiveness of all those whom I have injured."

After the hearing, both Kobs and St. Patrick expressed frustration with Giannini's sentence.

"I would have liked her to have served 4 years in prison," Kobs said. "But 1 year in jail is better than none."

St. Patrick added, "When will we start dealing with the female rapists in the same way that we deal with male rapists?"

Sister Betty Smith, president of the Sisters of Mercy regional community of Chicago, read a statement expressing the order's regret for the pain experienced by Kobs, St. Patrick "and anyone else touched by this situation."

Court documents obtained by the Tribune this week indicate that Giannini admitted to a church review board in 1996 that she had molested at least four other boys, including one in Chicago before her transfer to Milwaukee.

"The Sisters of Mercy pray that all can move forward with compassion and that healing begins," Smith said.

Although church officials knew in the 1990s of the allegations against Giannini, they did not contact civil authorities. Prosecutors began building their case in 2005 after Kobs and St. Patrick contacted law enforcement officials. Giannini was charged in December 2006 and pleaded no contest in November, just before trial.

Wisconsin was able to prosecute Giannini because she returned to Illinois before the six-year statute of limitations on her crimes had expired. In Wisconsin, the expiration on statute of limitations is suspended as long as the perpetrator remains out of state.

Assistant District Atty. Paul Tiffin said Giannini must report to the correctional facility in the next 60 days. She must serve her probation in Milwaukee County, he said.
