Der Südafrikaner Michael Hickmann, der Franzose Maurice Elfeke und die beiden Deutschen Bernd Uhl und Gerhard Hanekamp haben gestern in Wilhelmshaven in der Fußgängerzone der Bahnhofstraße für das Recht demonstriert, sich um ihre Kinder kümmern zu dürfen.
Die Vier gehören zu einer Gruppe von Vätern, die sich seit dem 11. Juli bis Anfang August an einem Hungerstreik auf dem Alexanderplatz in Berlin beteiligten, um auf die Sorge- und Umgangsrechtsproblematik bei Kindern getrennter Eltern - insbesondere, wenn sie aus verschiedenen Ländern stammen - aufmerksam zu machen.
Aktueller Anlass in Wilhelmshaven war gestern der Termin Hickmans beim Familiengericht des Amtsgerichts, wo der in Durban lebende Umweltberater einen Antrag auf das gemeinsame Sorgerecht für die beiden hier bei der Mutter lebenden Söhne gestellt hat. In den vergangenen mehr als 2000 Tagen habe er die jetzt fast acht und elf Jahre alten Kinder nur vier Mal sehen können.
Vielfach habe er vergebens den 15-stündigen Flug von Südafrika nach Deutschland unternommen, weil ihm dann in Wilhelmshaven der Besuch der Kinder von der Mutter nicht ermöglicht worden war. Die zuständigen Behörden hätten ihm ebenfalls nicht zur Durchsetzung seines Umgangsrechts verholfen. Die Ehe des Südafrikaners mit der Deutschen war Anfang 1996 endgültig auseinandergebrochen, nachdem seine Frau im Februar ohne sein Wissen mit den zwei und sechs Jahre alten, in Südafrika geborenen Kindern zurück nach Wilhelmshaven geflogen war.
Seit Oktober 1999 flog Hickman siebenmal nach Deutschland, tatsächlich treffen konnte er seine Kinder zuletzt im April 2000. Die Versuche, mit ihnen Kontakt aufzunehmen und sein Recht vor Gericht zu erstreiten, haben ihn nach eigenen Bekundungen inzwischen eine halbe Million Mark gekostet.
Die Mutter habe offenbar Angst, dass die Kinder entführt würden. Unbegründet, meint Hickman, da sie in solch einem Fall sofort von Südafrika nach Deutschland zurückgeschickt würden.
Vertreten wird Hickman jetzt von dem französischen Anwalt Matthias Bloch, der Büros in Paris und Berlin hat und auf die Thematik spezialisiert ist. Sein Hauptargument: "Umgangsrecht hat eine Menschenrechtsdimension und Umgangsvereitelung ist kein Kavaliersdelikt."
Der Familienrichter beim Amtsgericht hat nach Hickmans Empfinden die Tür ein Stück geöffnet. Dienstag soll er seine Söhne sehen. Bloch: "Wir gehen davon aus, dass die Wiederanbahnung des Kontakts positiv verlaufen wird und eine generelle Normalisierung der Beziehungen einsetzt."

Yesterday in the pedestrian zone near the Wilhelmshaven train station, Michael Hickmann from South Africa, Maurice Elfeke from France and two German citizens, Bernd Uhl and Gerhard Hanekamp demonstrated for the right to be allowed to care about their children.
The four belong to a group of fathers, who took part in a hunger strike from July 11th to the beginning of August on the Alexanderplatz in Berlin, in order to bring attention to the custody and visitation problem with children of separate parents - in particular, if they
belong in different countries.
The current cause for action in Wilhelmshaven was Hickman's hearing yesterday with the family court of the district court, where the
environmental advisor living in Durban had filed a request for the common custody for the two sons living here with the mother. Since over 2000 days, he was allowed to see the children - now nearly eight and eleven of years old - only four times.
All too often he undertook the 15-hour flight from South Africa to Germany for nothing, because when he arrived in Wilhelmshaven, access to the children was not allowed by the mother. The responsible authorities have not helped him likewise in the exercise of his access rights. The marriage of the South African with the German had broken up definitively at the beginning of 1996, after his wife had flown without his knowledge back to Wilhelmshaven with the two children born in South Africa, at the age of two and six years old.
Since October 1999 Hickman flew seven times to Germany, but could only actually meet his children at last in April 2000. The attempts to resume contact with them and to assert his rights before court have cost him, by own reckoning, a half million mark [260'000 euro].
The mother evidently fears that the children would be abducted. Without cause, says Hickman, since they would be returned immediately in such a case from South Africa to Germany.
Hickman is represented now by the French lawyer Matthias Bloch, who has offices in Paris and Berlin and specializes in the topic. His main argument: "Access rights have a human rights dimension, and obstruction to visitation is not a harmless infraction".
The family judge with the district court opened the door a crack, according to Hickman's feeling. He is supposed to see his sons Tuesday. Bloch: "We assume the resumption of contact will run smoothly, and a general normalization of relations will recommence."

Le Sud-Africain Michael Hickman, le Français Maurice Elfeke et les deux Allemands Bernd Uhl et Gerhard Hanenkamp ont manifesté hier à Wilhelmshaven dans la zone piétonnière de la Bahnhofstrasse pour le droit de s'occuper de leurs enfants.
Les quatre appartiennent à un groupe de pères qui ont participé, du 11 juillet jusqu'au début du mois d'août, à une grève de la faim sur la Alexanderplatz à Berlin, pour attirer l'attention sur le problème du droit de garde et du droit de visite pour enfants de parents séparés - surtout quand ils sont originaires de pays différents.
L'occasion actuelle à Wilhelmshaven fut hier l'audience de Hickman à la chambre de la famille du tribunal d'instance, où le conseiller en environnement vivant à Durban a fait une demande de garde commune pour les deux fils qui vivent ici chez la mère. Il dit que depuis plus de 2000 jours, il n'a pu voir que quatre fois les enfants, agés maintenant de presque huit et onze ans.
Il dit qu'il a souvent entrepris le vol de 15 heures d'Afrique du Sud vers l'Allemagne pour rien, vu que, une fois à Wilhelmshaven, la mère ne lui a pas rendu possible la visite des enfants. Quant aux autorités compétentes, elles ne l'ont, selon lui, pas aidé à faire exécuter son droit de visite. Le mariage du Sud-Africain avec l'Allemande se cassa définitivement au début de l'année 1996, après que, en février, sa femme fut retournée en avion à Wilhelmshaven à son insu, avec les enfants agés de deux et de six ans et nés en Afrique du Sud.
Depuis octobre 1999, Hickman prit sept fois l'avion pour l'Allemagne; c'est en avril 2000 qu'il put pour la dernière fois effectivement rencontrer ses enfants. Les tentatives de prendre contact avec eux et d'obtenir son droit en justice l'ont entre-temps couté, selon sa propre déclaration, un demi million de marks [260'000 euros].
Selon lui, la mère a apparemment peur que les enfants soient enlevés. Sans raison, dit Hickman, car dans un tel cas, ils seraient renvoyés immédiatement par l'Afrique du Sud en Allemagne.
Hickman est maintenant représenté par l'avocat français Matthias Bloch qui a des bureaux à Paris et à Berlin et qui est spécialisé dans ce sujet. Son argument principal: "Le droit de visite a une dimension relevant des droits de l'homme, et l'empêchement de visites n'est pas une peccadille."
Selon le sentiment de Hickman, le juge aux affaires familiales du tribunal d'instance a ouvert la porte un petit peu. Mardi, il doit voir ses fils. Bloch: "Nous supposons que le renouement du contact se déroulera de manière positive, et qu'une normalisation générale des relations commencera."
